1. Our Commitment to Accessibility

Hybrid Funder LLC is committed to ensuring that its website, hybridfunder.com, and all digital content and services are accessible to all users, including individuals with disabilities. We believe that equal access to financial information and services is a fundamental right, and we are dedicated to removing digital barriers that may prevent individuals with disabilities from fully accessing our platform.

We recognize that accessibility is an ongoing effort, not a one-time project. We continuously review, test, and improve our digital presence to meet or exceed applicable accessibility standards and to provide an equitable experience for all users regardless of ability.

2. Accessibility Standards We Follow

Hybrid Funder LLC strives to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, published by the World Wide Web Consortium (W3C). WCAG 2.1 Level AA is the internationally recognized technical standard for web accessibility and the standard referenced by the Americans with Disabilities Act (ADA) Title III in litigation involving private business websites.

Our accessibility efforts are guided by the four core principles of WCAG, often referred to as POUR:

Perceivable: Information and user interface components must be presented in ways that all users can perceive. This includes providing text alternatives for non-text content, captions for videos, and content that can be adapted without losing meaning.

Operable: All functionality must be accessible via keyboard navigation and must not require interactions that users cannot perform. This includes providing sufficient time to read content, avoiding content that could cause seizures, and providing navigation assistance.

Understandable: Information and operation of the user interface must be understandable to all users. Text must be readable, pages must function predictably, and input assistance must be available.

Robust: Content must be robust enough to be interpreted reliably by a wide variety of current and future assistive technologies, including screen readers, voice recognition software, and alternative input devices.

3. Legal Framework and Applicable Law

3.1 Americans with Disabilities Act (ADA) — Title III

Title III of the Americans with Disabilities Act prohibits discrimination on the basis of disability in places of public accommodation. Federal courts have consistently held that websites of private businesses, including financial services companies, constitute places of public accommodation subject to Title III requirements. Hybrid Funder LLC is committed to meeting its obligations under Title III by working toward WCAG 2.1 Level AA conformance.

3.2 Section 508 of the Rehabilitation Act

While Section 508 applies primarily to federal agencies and federally funded programs, Hybrid Funder LLC voluntarily aligns its accessibility practices with Section 508 standards as a best practice for ensuring broad accessibility.

3.3 New York State Human Rights Law and New York City Human Rights Law

Hybrid Funder LLC operates from New York and serves clients nationwide. New York State and New York City have broad anti-discrimination laws that courts have applied to digital environments. New York is among the most legally active jurisdictions for digital accessibility enforcement. We take our obligations under New York law seriously and are committed to providing equal access to users in New York and across all states.

Note: New York State enacted legislation (S3114A, effective June 2024) requiring all New York state agencies and contractors to conform to the most current WCAG standards. As a company doing business with New York entities, we monitor these requirements closely.

3.4 California Unruh Civil Rights Act

California's Unruh Civil Rights Act provides broad civil rights protections to California residents, including protections against disability-based discrimination in digital environments. Hybrid Funder LLC is committed to providing accessible services to California-based business owners and applicants.

3.5 Air Carrier Access Act and Other Federal Statutes

To the extent any other federal or state accessibility statutes apply to Hybrid Funder LLC's operations or digital presence, we are committed to compliance with those requirements as well. We monitor federal and state accessibility legislation on an ongoing basis.

4. Current Accessibility Status

Hybrid Funder LLC is actively working toward conformance with WCAG 2.1 Level AA. We acknowledge that some areas of our website may not yet fully meet these standards, and we are committed to continuous improvement. Our current accessibility efforts include:

•        Use of semantic HTML structure to support screen reader navigation

•        Provision of text alternatives for images and visual content where feasible

•        Keyboard-navigable interface elements including forms and navigation menus

•        Use of sufficient color contrast ratios for text and interface elements

•        Clear, descriptive link text to aid navigation by assistive technology users

•        Avoidance of content that flashes more than three times per second to reduce seizure risk

•        Form fields with associated labels and error identification

•        Responsive design to support users accessing content on mobile devices and varying screen sizes

We recognize that accessibility audits using automated tools identify only a portion of potential WCAG issues. We are committed to supplementing automated scanning with manual review processes over time to more comprehensively identify and remediate accessibility barriers.

5. Known Limitations and Remediation Timeline

We are aware that our website may have areas that do not yet fully conform to WCAG 2.1 Level AA. Known areas we are actively working to improve include:

•        Third-party embedded content and tools, which may have their own accessibility limitations outside our direct control

•        Certain PDF documents and downloadable resources, which we are working to make fully accessible

•        Video content, for which we are working to provide captions and audio descriptions

•        Complex interactive form elements, which we are reviewing for full keyboard and screen reader accessibility

We prioritize remediation of barriers that affect users' ability to access our core services, including our business financing application process, contact forms, and informational content. We are committed to addressing identified accessibility barriers on a rolling basis and will update this statement as improvements are made.

10. Third-Party Content and Tools

Our website may include content, tools, or functionality provided by third-party vendors, including analytics platforms, form processors, advertising networks, and other service providers.
